PRIVACY NOTICE
regarding the processing of personal data of study candidates by Med-Europe sp. z o.o.
Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L 119, 4.5.2016, p. 1, as amended), hereinafter: the “GDPR”, Med-Europe sp. z o.o. informs you that:
1) The controller of your personal data is Med-Europe sp. z o.o., with its registered office at ul. Jaśminowa 17, 63-000 Środa Wielkopolska, Poland, entered in the register of entrepreneurs under KRS number 001240892, NIP (Tax ID): 7861739236, REGON: 544724171 (hereinafter: the “Controller”).
2) The Controller has not appointed a Data Protection Officer. For all matters relating to the processing of personal data and the exercise of rights under the GDPR, you may contact the Controller directly by e-mail at: support@studymedicinepoland.com, or in writing at the registered office address indicated in point 1.
3) Scope and purposes of processing personal data:
Art. 6(1)(b) GDPR | necessity for the performance of a contract and for taking steps prior to entering into a contract — processing is necessary to carry out the recruitment process for a candidate applying to a partner higher education institution located in the European Economic Area (EEA), with which Med-Europe sp. z o.o. cooperates under student recruitment service agreements (verification of documentation, presentation of study offers, assistance in completing recruitment documents, and assistance in organising the trip to take up studies) |
Art. 6(1)(c) GDPR | processing is necessary for compliance with a legal obligation to which the Controller is subject, including obligations arising from accounting and tax regulations |
Art. 6(1)(f) GDPR | the Controller’s legitimate interest, consisting of: providing informational and advisory activities to candidates, establishing, pursuing or defending against potential claims, and maintaining internal recruitment records and statistics |
Art. 6(1)(a) GDPR | consent — for the purpose of sending newsletters and electronic communications regarding: • recruitment for studies, • fields of study, • partner universities, • webinars, • events, • educational materials, • services provided by Med-Europe sp. z o.o. |
The consent referred to above (Art. 6(1)(a) GDPR) is voluntary and may be withdrawn at any time, without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal. Withdrawal of consent does not affect the processing of data carried out on any other legal basis referred to in this notice.
4) Providing personal data is voluntary; however, it is necessary in order to take part in the recruitment process conducted with the involvement of the Controller and to benefit from its support — failure to provide the data will prevent the purposes referred to in point 3 from being achieved.
5) The categories of data processed include, in particular: identification and contact details, data contained in recruitment documents (including school-leaving certificates and examination results), data relating to the course of the recruitment process, and — to the extent necessary to organise travel and accommodation — other data voluntarily provided by the candidate for that purpose.
6) Recipients of data. Personal data may be disclosed to:
higher education institutions located in the European Economic Area (EEA) to which the candidate applies through the Controller — to the extent necessary to carry out the recruitment procedure and admission to studies, on the terms set out in the agreement between the Controller and the relevant institution and — where required — only in respect of candidates who have given separate consent to the disclosure of information on their candidate status within that institution’s recruitment system;
entities providing accounting, legal, IT and other services supporting the Controller’s activities, on the basis of data processing agreements concluded with the Controller;
providers of CRM systems used to manage relationships with candidates;
providers of mailing systems used to send newsletters and to communicate with candidates;
providers of cloud services in which personal data is stored;
providers of communication tools (including e-mail and webinar platforms);
entities authorised to receive such data under applicable law.
An up-to-date list of the partner universities with which the Controller cooperates is available on the website www.studymedicinepoland.com or upon individual request sent to the address indicated in point 2 above.
7) Transfers of data within the EEA and to third countries. The provision of services by the Controller involves the transfer of candidates’ personal data to partner universities located within the European Economic Area (EEA), including in particular in Poland — which does not constitute a transfer to a third country within the meaning of the GDPR. In the case of candidates residing in, or nationals of, the United Kingdom of Great Britain and Northern Ireland (a third country following its withdrawal from the European Union), the Controller processes their data in accordance with the data protection legislation applicable there, and the transfer of such data to the EEA (to the partner university) takes place on the basis of the European Commission’s adequacy decision regarding the United Kingdom (Commission Implementing Decision (EU) 2021/1772) or on the basis of standard contractual clauses, depending on the legal framework in force at the time of processing. Personal data is not transferred to any other third countries or to international organisations.
8) Data retention period. Personal data of candidates who were not referred to a university or who withdrew from the recruitment process will be retained for a period of 3 years from the end of the relevant recruitment cycle. Data of candidates admitted to studies will be retained for the entire duration of their studies, and thereafter for the period required by applicable law (including accounting and tax regulations) or until any claims arising from the agreements between the parties become time-barred. Data processed on the basis of marketing consent (Art. 6(1)(a) GDPR) will be retained until such consent is withdrawn or an objection to such processing is raised.
9) Candidates who are minors. In the case of candidates who have not reached the age of 18 at the time their data is collected, the Controller may also contact their parent or legal guardian in matters relating to the recruitment process. The contact details of a parent/legal guardian are processed on the basis of the Controller’s legitimate interest (Art. 6(1)(f) GDPR), consisting of ensuring proper communication during the recruitment process of a minor.
10) You have the following rights:
to access your data and obtain a copy of it;
to rectify (correct) your personal data;
to restrict the processing of your personal data in cases provided for by law;
to erasure of your data — in cases provided for by law;
to object to the processing of your data, in particular where the processing is based on the Controller’s legitimate interest;
to data portability, where processing is carried out by automated means and is based on a contract or on consent;
to withdraw your consent at any time, where processing is based on consent (Art. 6(1)(a) GDPR), without affecting the lawfulness of processing carried out before its withdrawal.
11) Your personal data will not be subject to automated decision-making, including profiling.
12) You have the right to lodge a complaint with the supervisory authority responsible for data protection — in Poland, this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), and, for individuals residing in Ireland, also the Data Protection Commission (DPC). Lodging a complaint in Ireland or in another EU/EEA member state does not exclude the possibility of also lodging a complaint with the President of the Polish Personal Data Protection Office.

KLAUZULA INFORMACYJNA
dot. przetwarzania danych osobowych kandydatów na studia przez Med-Europe sp. z o.o.
Zgodnie z art. 13 ust. 1 i 2 rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz. Urz. UE L 119 z 4.05.2016, str. 1, ze zm.), dalej: „RODO”, Med-Europe sp. z o.o. informuje, że:
1) Administratorem Pani/Pana danych osobowych jest Med-Europe sp. z o.o. z siedzibą przy ul. Jaśminowej 17, 63-000 Środa Wielkopolska, wpisana do rejestru przedsiębiorców KRS pod numerem 001240892, NIP: 7861739236, REGON: 544724171 (dalej: „Administrator”).
2) Administrator nie wyznaczył Inspektora Ochrony Danych. We wszystkich sprawach dotyczących przetwarzania danych osobowych oraz realizacji praw wynikających z RODO można kontaktować się bezpośrednio z Administratorem pod adresem e-mail: support@studymedicinepoland.com lub pisemnie na adres siedziby wskazany w pkt 1.
3) Zakres i cel przetwarzania danych osobowych:
art. 6 ust. 1 lit. b RODO | niezbędność do wykonania umowy oraz podjęcia działań przed jej zawarciem — przetwarzanie danych jest niezbędne w celu przeprowadzenia procesu rekrutacji kandydata na studia na uczelni partnerskiej na terenie Europejskiego Obszaru Gospodarczego (EOG), z którą Med-Europe sp. z o.o. współpracuje w ramach umów o świadczenie usług rekrutacji studentów (weryfikacja dokumentacji, przedstawienie oferty studiów, pomoc w skompletowaniu dokumentów rekrutacyjnych oraz w organizacji wyjazdu na studia) |
art. 6 ust. 1 lit. c RODO | przetwarzanie jest niezbędne do wypełnienia obowiązków prawnych ciążących na Administratorze, w tym wynikających z przepisów o rachunkowości i podatkach |

Zgoda, o której mowa powyżej (art. 6 ust. 1 lit. a RODO), jest dobrowolna i może zostać wycofana w dowolnym momencie, bez wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem. Wycofanie zgody nie wpływa na przetwarzanie danych odbywające się na innych podstawach prawnych wskazanych w niniejszej klauzuli.
4) Podanie danych osobowych jest dobrowolne, jednak niezbędne do wzięcia udziału w procesie rekrutacji prowadzonym z udziałem Administratora oraz do skorzystania z jego wsparcia — ich niepodanie uniemożliwi realizację celów wskazanych w pkt 3.
5) Kategorie przetwarzanych danych obejmują w szczególności: dane identyfikacyjne i kontaktowe, dane zawarte w dokumentach rekrutacyjnych (m.in. świadectwa, wyniki egzaminów), dane dotyczące przebiegu procesu rekrutacji oraz — w zakresie niezbędnym do organizacji wyjazdu i zakwaterowania — inne dane przekazane przez kandydata dobrowolnie w tym celu.
6) Odbiorcy danych. Dane osobowe mogą być przekazywane:
uczelniom wyższym na terenie Europejskiego Obszaru Gospodarczego (EOG), do których kandydat aplikuje za pośrednictwem Administratora — w zakresie niezbędnym do przeprowadzenia procedury rekrutacyjnej i przyjęcia na studia, na zasadach określonych w umowie łączącej Administratora z daną uczelnią oraz — tam gdzie jest to wymagane — wyłącznie wobec kandydatów, którzy wyrazili odrębną zgodę na udostępnienie informacji o statusie kandydata w systemie rekrutacyjnym danej uczelni;
podmiotom świadczącym na rzecz Administratora usługi księgowe, prawne, informatyczne oraz inne usługi wspierające jego działalność, na podstawie zawartych umów powierzenia przetwarzania danych;
dostawcom systemów CRM wykorzystywanych do zarządzania relacjami z kandydatami;
dostawcom systemów mailingowych, wykorzystywanych do wysyłki newslettera oraz komunikacji z kandydatami;
dostawcom usług chmurowych, w których przechowywane są dane osobowe;
dostawcom narzędzi komunikacyjnych (m.in. poczty elektronicznej, platform do organizacji webinarów);
podmiotom uprawnionym do tego na mocy przepisów prawa.
Aktualna lista uczelni partnerskich, z którymi współpracuje Administrator, dostępna jest na stronie internetowej www.studymedicinepoland.com lub na indywidualne zapytanie skierowane na adres wskazany w pkt 2 powyżej.
7) Przekazywanie danych w ramach EOG oraz do państw trzecich. Realizacja usług przez Administratora wiąże się z przekazywaniem danych osobowych kandydatów do uczelni partnerskich zlokalizowanych na terenie Europejskiego Obszaru Gospodarczego (EOG), w tym w szczególności w Polsce — co nie stanowi transferu do państwa trzeciego w rozumieniu RODO. W przypadku kandydatów przebywających lub pochodzących ze Zjednoczonego Królestwa Wielkiej Brytanii i Irlandii Północnej (państwa trzeciego po opuszczeniu Unii Europejskiej), Administrator przetwarza ich dane zgodnie z obowiązującymi tam przepisami o ochronie danych osobowych, a przekazanie tych danych na obszar EOG (do uczelni partnerskiej) odbywa się na podstawie decyzji Komisji Europejskiej stwierdzającej odpowiedni stopień ochrony danych osobowych w Zjednoczonym Królestwie (decyzja wykonawcza Komisji (UE) 2021/1772) bądź na podstawie standardowych klauzul umownych, w zależności od aktualnego stanu prawnego obowiązującego w dacie przetwarzania. Dane osobowe nie są przekazywane do innych państw trzecich ani do organizacji międzynarodowych.
8) Okres przechowywania danych. Dane osobowe kandydatów, którzy nie zostali skierowani na studia lub zrezygnowali z procesu rekrutacji, będą przechowywane przez okres 3 lat od zakończenia danego cyklu rekrutacyjnego. Dane kandydatów przyjętych na studia będą przechowywane przez cały okres trwania studiów, a następnie przez okres wymagany przepisami prawa (w tym przepisami o rachunkowości i podatkami) lub do czasu przedawnienia ewentualnych roszczeń wynikających z łączących strony umów. Dane przetwarzane na podstawie zgody marketingowej (art. 6 ust. 1 lit. a RODO) będą przechowywane do czasu wycofania zgody lub wniesienia sprzeciwu wobec takiego przetwarzania.
9) Kandydaci niepełnoletni. W przypadku kandydatów, którzy w momencie zbierania danych nie ukończyli 18. roku życia, Administrator może kontaktować się w sprawach związanych z procesem rekrutacji również z ich rodzicem lub opiekunem prawnym. Dane kontaktowe rodzica/opiekuna prawnego przetwarzane są na podstawie prawnie uzasadnionego interesu Administratora (art. 6 ust. 1 lit. f RODO), polegającego na zapewnieniu prawidłowej komunikacji w procesie rekrutacji osoby niepełnoletniej.
10) Przysługują Pani/Panu następujące prawa:
dostępu do swoich danych oraz otrzymania ich kopii;
sprostowania (poprawiania) swoich danych osobowych;
ograniczenia przetwarzania danych osobowych w przypadkach przewidzianych przepisami prawa;
usunięcia danych — w przypadkach przewidzianych przepisami prawa;
wniesienia sprzeciwu wobec przetwarzania danych, w szczególności gdy podstawą przetwarzania jest prawnie uzasadniony interes Administratora;
przenoszenia danych osobowych, jeśli przetwarzanie odbywa się w sposób zautomatyzowany, a podstawą przetwarzania jest umowa lub zgoda;
wycofania zgody w każdym czasie, jeżeli przetwarzanie odbywa się na podstawie zgody (art. 6 ust. 1 lit. a RODO), bez wpływu na zgodność z prawem przetwarzania dokonanego przed jej wycofaniem.
11) Dane osobowe nie będą podlegały zautomatyzowanemu podejmowaniu decyzji, w tym profilowaniu.
12) Przysługuje Pani/Panu prawo wniesienia skargi do organu nadzorczego właściwego dla ochrony danych osobowych — w Polsce jest to Prezes Urzędu Ochrony Danych Osobowych, a w przypadku osób przebywających w Irlandii — również do Data Protection Commission (DPC). Skorzystanie z prawa wniesienia skargi w Irlandii lub innym państwie UE/EOG nie wyłącza możliwości wniesienia skargi do Prezesa UODO.
